Evidence supplied by me to both the Victorian State Government and the Federal Government confirms beyond any doubt that legal-related faxes leaving the Chambers of Owen Dixon in Melbourne (the leading legal chambers in Melbourne, Australia) en route to the Supreme Court of Victoria were hacked (screened) before arriving at the Appeal Judges Chambers. When I explained to Barrister Peter Hiland of Consumer Affairs Victoria in front of two witnesses that this is how Telstra has been winning their legal claims against their customers for years, Mr Hiland said this was the type of evidence he and the CAV had been waiting for, and it would be investigated. Thirty-six spiral-bound files of evidence showing that Telstra has been using unlawful conduct to win their legal/arbitration process were under investigation by the CAV between 2007 and 2010, and no finding has yet been brought down.

Mr. Hiland, the barrister, was delighted when I provided evidence that faxes leaving the Sir Owen Dixon Chambers in Melbourne were intercepted before reaching their intended destination. He was also disturbed that neither the TIO nor Telstra returned the evidence confirming that faxes from the Crown casino complex, intended for another recipient, arrived at my Cape Bridgewater business. Five years after the CAV took possession of the evidence, it was returned to me in disarray, suggesting it had been investigated. However, like the government's review process in 2006 - Chapter 8 - The eighth remedy pursued, the CAV investigation by the CAV which started in 2007 - Chapter 10 - The tenth remedy pursued and the third investigation, which began in 2009 - Chapter 11 - The eleventh remedy pursued no finding has been handed down on any of those three investigations.

It's important to consider the facts presented in the text above. The involvement of Deloitte as Telstra's arbitration financial accountant, along with the discrepancies in their findings compared to AUSTEL’s Adverse Findings (the government regulatory report), is a cause for concern. Additionally, the fact that Telstra funded all three auditing companies involved in the arbitration process instead of the government, which endorsed the process, raises questions about the integrity of the process. It's essential to ensure that arbitration processes are fair, just, and transparent. We should all demand accountability and transparency in such matters to ensure that justice is served.

Ann's Garms was prepared to go live on her YouTube video below about her arbitration and appeal process, which coincides with how the Senate voiced its opinion about the arbitration processes.

How does one articulate a story so extraordinary that even the author is sceptical of its authenticity until verifying the records? How does one expose collusion between an arbitrator, various appointed government watchdogs, and the defendants? In my case, the defendants, a government-owned telecommunications carrier, intercepted and screened my faxed material using equipment connected to their network.

They surreptitiously stored it without my knowledge or consent before redirecting it to its intended destination, sometimes unsuccessfully. Remarkably, the arbitrator's consultants deemed my claim material as indecipherable. However, both of the arbitration consultants I had employed were senior detectives and licensed loss assessors. When my claim material reached the arbitrator, it had been tampered with and rearranged to make no sense.

This was further corroborated by the fact that when the arbitrator returned my claim material three months after the arbitration, several of Ann Garms' claim documents were attached to mine, even though she transmitted her material from a location over 1,000 km away. I presented this compelling evidence to the Telecommunications Industry Ombudsman (TIO). Nevertheless, neither John Pinnock (TIO) nor his deputy Wally Rothwell transparently investigated the matter, although Ann Garms had appealed her arbitration award in the Supreme Court of Victoria.

Such behaviour undermines our trust in our justice system and institutions, which are expected to safeguard the rights of individuals and organizations. As a community, we must stand against such practices and demand transparency and equity in our legal processes.

Absent Justice - My Story - Senator Ron Boswell

Threats made and carried out.

Page 180 ERC&A, from the official Australian Senate Hansard, dated November 29 1994, reports Senator Ron Boswell asking Telstra's legal directorate why were my FOI documents being withheld from me during my arbitration:

“Why did Telecom advise the Commonwealth Ombudsman that Telecom withheld FOI documents from Alan Smith because Alan Smith provided Telecom FOI documents to the Australian Federal Police during their investigation?”

After receiving a hollow response from Telstra, which the senator, the AFP and I all knew was utterly false, the senator states:

“…Why would Telecom withhold vital documents from the AFP? Also, why would Telecom penalise COT members for providing documents to the AFP which substantiate that Telecom had conducted unauthorised interceptions of COT members’ communications and subsequently dealt in the intercepted information by providing that information to Telecom’s external legal advisers and others?” (Senate Evidence File No 31)

As I have reiterated throughout this website, the threats against me during the arbitration proceedings came to fruition, and the withholding of pertinent documents is deeply concerning. Regrettably, neither the Telecommunications Industry Ombudsman nor the government has investigated the detrimental impact of this malpractice on my overall submission to the arbitrator. Despite assisting the Australian Federal Police (AFP) in their investigation into the illicit interception of phone conversations and arbitration-related faxes, they never came to my aid.
